TERMS & CONDITIONS

forgottengold.com is the business name of Glasson Recycling Ltd, a company incorporated in the Republic of Ireland hereafter referred to as “Glasson Recycling”. By requesting a forgottengold.com Gold Recycle Pack, either by telephone or via our online order form, you the Customer hereby agree and accept in their entirety the terms and conditions set forth below. Glasson Recycling purchases second hand gold jewellery for recycling. All gold jewellery (also referred to as second hand, old, broken, unwanted or forgotten gold) purchased is treated as scrap gold, is melted down and refined and is not for resale. Prices are based solely on the weight and the karat grade of the gold contained in the gold jewellery, not on its potential value if resold intact.

Requirements For Use:

Each Customer must be at least eighteen (18) years of age in order to sell gold jewellery to Glasson Recycling. Each Customer must be the lawful owner of all gold jewellery submitted and may not be acting as an agent or representative of the actual owner. Glasson Recycling may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.

Recycle Request Card:

You, the Customer, agree to complete and sign the Recycle Request Card. The Recycle Request Card can be downloaded from our website and printed or you can receive a Recycle Request Card from us by post as part of the Gold Recycle Pack. If we determine, in our sole discretion, that insufficient information has been provided, or if no Recycle Request Card was included in the package, we may suspend or terminate the transaction with notice to you. In the event that we terminate the transaction, we will post your gold jewellery to you within two (2) business days at our cost and you agree that we will only be responsible for insuring the value of your gold jewellery up to a maximum of Three Hundred Euro (€300). In the event that a return address is not provided by you, we will hold the jewellery for a period of two (2) months, during which time the jewellery may be claimed. Any claims must be reasonably supported by evidence of ownership. Any jewellery remaining unclaimed after two months will be recycled and the proceeds donated to a charity nominated by Glasson Recycling Limited.

Guarantee Against Loss:

We provide each Customer with specific instructions regarding how each Customer must send their gold jewellery to us using the postal service and a free post envelope provided by Glasson Recycling as part of the Gold Recycle Pack. In the event that the Customer strictly follows these instructions and uses the free post envelope, Glasson Recycling guarantees against loss to the maximum value of Three Hundred Euro (€300) of the total contents properly sent by post to Glasson Recycling in accordance with the instructions outlined in the Recycle Request Card provided as part of the forgottengold.com Gold Recycle Pack and subject to the terms and conditions herein. The Customer is obliged to provide proof of postage documentation (provided free of charge and on request at the Post Office) in order to make any claim against this guarantee. Glasson Recycling reserves the right, in its sole discretion, to reject delivery of any post, envelope or package which appears to be damaged, opened, or tampered with and any such post, envelope or package will be returned by the Post Office to the Customer. Glasson Recycling shall have no liability to any Customer for any such attempted delivery or return of any such post, envelope or package.

Claim Period and Related Restrictions:

All claims must be submitted within thirty (30) days of the date of loss and must be submitted on the supplied forgottengold.com Claim Form, which is available upon request. Each Claim Form must be accurately completed and provided to Glasson Recycling within the thirty day (30) claim period, complete with all required documentation as set forth herein including proof of postage documentation and as requested by Glasson Recycling or the claim will be summarily rejected by Glasson Recycling. No claim may be submitted until fifteen (15) days has elapsed from the date you posted your post, envelope or package to us in order to ensure that your package has had sufficient time to arrive to our offices. Failure to properly complete, sign and/or post the Claim Form together with PROOF OF POSTAGE will result in the denial of the Claim by Glasson Recycling.

“Get Started Now” Option:

You can choose to post your gold jewellery to us at your own risk and expense by choosing the “Get Started Now” option on forgottengold.com, in which case you agree to download and print a Recycle Request Card from our website. If you choose not to use the freepost envelope provided by us as part of the Gold Recycle Pack, in any event, you agree to pay for all inbound postage expenses, to insure your gold jewellery at your own cost and to waive any and all claims against Glasson Recycling for any loss or damage to the gold jewellery during transit. Any claims for lost or destroyed gold jewellery must be made against the service provider you selected.

Return Insurance Liabilities:

If gold jewellery is returned to a Customer, Glasson Recycling will insure the jewellery for the amount offered to purchase by Glasson Recycling up to a maximum value of Three Hundred Euro (€300) regardless of what it was insured for by the Customer to Glasson Recycling. The Customer agrees to waive any losses not covered by the amount of insurance provided accordingly by Glasson Recycling. Glasson Recycling shall, in its sole discretion, choose the return carrier and receipt verification method for each such transaction. In the event that the gold jewellery returned to the Customer is lost, the Customer’s sole remedy is to seek reimbursement via the insurance provided by Glasson Recycling.

Limitation of Liability:

Subject to the terms and conditions set forth herein, Glasson Recycling will be liable only for the maximum sum of Three Hundred Euro (€300). Consequently, the Customer understands and agrees that Glasson Recycling liability is limited to this sum. The Customer agrees to hold Glasson Recycling harmless and to indemnify Glasson Recycling regarding any other losses or damages, including any incidental, indirect, special, consequential, punitive damages, or loss of profit or opportunity; claims, demands, or actions for any subrogation claim brought by the Customer’s insurance company, and, by submitting gold jewellery to Glasson Recycling the Customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance company. By submitting the gold jewellery, the Customer explicitly and expressly accepts this limitation of liability. The Customer is free to insure the gold jewellery sent to Glasson Recycling for any amount that the Customer wishes. Glasson Recycling however, will provide insurance for returned items at the amount as set forth herein regardless of the amount of insurance purchased by the Customer regarding items set to Glasson Recycling.

Oral and Written Recycle Valuation Report and Acceptance:

Glasson Recycling will contact each Customer including by telephone or email to provide the results of the Recycle Valuation in relation to the gold jewellery submitted and an offer to purchase. Due to the fluctuating market price for gold, the Recycle Valuation and offer to purchase at the specified price issued to the Customer is valid only for thirty six (36) hours. In the event that Glasson Recycling agrees to purchase some or all of the gold jewellery sent by the Customer and the Customer accepts such payment offered, then the Customer's payment shall be issued within twenty four (24) hours of the Customer’s acceptance of the Recycle Valuation findings and offer to purchase and the Customer's gold jewellery shall become the property of Glasson Recycling. Once the payment is issued, the Customer will not have the opportunity to return the payment and receive their gold jewellery.

In the event that the Customer is not completely satisfied with the Recycle Valuation and the payment offered by Glasson Recycling, we will return the gold jewellery to the Customer at Glasson Recycling’s cost within twenty four (24) hours of receipt of the rejection notification from the Customer by telephone or email regarding the Recycle Valuation and offer to purchase.

Customers provide Glasson Recycling with their email address, physical address, and telephone numbers and it is the Customer’s responsibility to provide us with any updated contact information. The Customer agrees that any email message that we send to the Customer is deemed to have been effectively received by the Customer and constitutes due notice to the Customer by email and that any phone message we leave with the Customer, or on the Customer’s voicemail is effectively received by the Customer and constitutes due notice to the Customer by telephone. In the event that we do not receive acceptance or rejection of the Recycle Valuation and offer to purchase by Glasson Recycling at the price indicated within thirty six (36) hours of the Recycle Valuation being delivered to the Customer by telephone or email, the offer to purchase the gold jewellery will automatically be withdrawn. We will continue to make reasonable efforts to contact the Customer for an additional fifteen (15) day period. If we are unable to make contact after fifteen (15) days the gold jewellery will then be returned to the Customer at Glasson Recycling’s cost.

Method of Payment:

You will receive a company cheque by post.

Jurisdiction:

The forgottengold.com website is operated and controlled by Glasson Recycling from Ireland. If you access the forgottengold.com website you do so at your own initiative and at your own risk and you are responsible for compliance with the applicable laws and regulations of the location in which you access the forgottengold.com website. The Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the Irish courts shall have exclusive jurisdiction for the purpose of any proceedings arising out of or in connection with the forgottengold.com website or the materials. If any provision of the Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Changes:

Any changes to the Terms and Conditions will be posted on the forgottengold.com website. Any such changes shall become immediately effective when posted. By using the forgottengold.com website you agree to be bound by any such changes and, therefore, you should from time to time visit the forgottengold.com website to determine the Terms and Conditions by which you are bound. Glasson Recycling, may at any time, without liability modify, suspend or discontinue the forgottengold.com website, the goods or services advertised on the forgottengold.com website, or any part thereof, with or without notice for any reason whatsoever.
